Although the restrictions related to Covid-19 have already been lifted, we have adopted some of the preventive measures permanently.

• Contracts and payments will be 100% digital. I will no longer have paper contracts and will no longer be accepting cash or check payments. All payments must be made with a credit/debit card (or with the Visa or MC logo) or ATH Móvil (at the business pATH PhotographyBySofia).

• The number of companions per session is limited to a maximum of one person. There will be the possibility of exceptions when we work with babies, but we must make arrangements it in advance. For family sessions, no additional companions will be allowed, only the people who will be photographed may be in the studio.

• With seasonal sessions, like Christmas, for example, the number of sessions per day is being limited. They are no longer consecutive, so spaces are even more limited.

• The number of props, bags, etc. you bring with you should be kept to a minimum. I have enough props and accessories for the sessions, but if you want to incorporate something in particular, let me know ahead of time so we can make arrangements.
  

• Although it will no longer be required, clients will be encouraged to bring and wear their mask while in the studio.

• I will be wearing a mask while I am working on your session and while there are people in the studio. I will also be wearing an apron while working with newborns.

• As the situation updates, additional measures may be taken.

• Photography by Sofía LLC reserves the right of admission and permanence.

If you prefer to send the payment through ATH Móvil, you can send it to the business pATH PhotographyBySofia. Please add your name and the date selected for your session in the notes section.

• Exclusive Photographer. Photography by Sofía, LLC (from now on, "PBS") will be the only authorized photographer to take photographs at the session. Friends and Family should not interfere with PBS's duties.
• Payments and deposits. All services require a deposit/retainer fee at the time of booking. Deposits/retainer fees are not refundable. Any pending balance should be paid on or before the day of the session. Payments can be made with a credit card or ATH Móvil. Late fees may be applied. 

• On Time.  We value our Clients' punctuality.  If the client runs into a situation that will not allow them to be on time to the session, they should let us know beforehand.  The session may be rescheduled, with no additional fees, within 5-10 days of the original date, subject to the type of session and spots availability, as long as the Client let us know beforehand that they won't be able to make it.  If the session is cancelled for a second time, a new retainer will be required to reschedule the session.  Sessions will be cancelled after 20 minutes if the client does not show without notice.
• Photographic Materials. All photographic materials, including but not limited to negatives, digital files, slides, proofs, etc., will be absolute property of PBS.  PBS does not offer RAW or unedited images.  PBS reserves the right to substitute any product, for another of equal or higher value, if the product ordered by the client is no longer available or has been discontinued by the manufacturer at the time of purchase. 

• Copyright and Reproductions. PBS will be the sole owner of all the images produced during the session and will have exclusive rights to reproduce the images. PBS will have exclusive rights to publish the images on any of their websites or social media sites, business cards or promotional materials. PBS will retain 100% of Copyrights. 

• Image use by the Client. The Client may use any photographic material or product provided by PBS for personal use only. The Client may not use the images or materials for commercial purposes or sell or publish the images without PBS's consent.

• Photographer. PBS may reschedule or cancel the session in case of an emergency or scheduling conflict. If these were to happen, PBS guarantees that the Client will get a competent Photographer in its place if PBS is not able to attend and the session can not be rescheduled.
• Weather Conditions, Technical Problems and Light Conditions on Location. If PBS cannot complete the session due to weather conditions, or if there should be technical problems on the location where the session/event will be held, or if the light conditions are not suitable on location PBS may reschedule or cancel the session and no deposits/retainers will be refunded.
• COVID-19 Protocols and Security Measures.  We have implemented Covid-19 health and security measures.  These protocols have been published on our website and social media outlets.  If the Client does not agree or comply to these protocols, the session will be cancelled immediately.  PBS reserves the right of admission and permanence to our facilities.
• Price List. Any changes in value, cost of products or services will be based upon the current price lists. And any future orders or services will be billed upon the current price lists. 

• Image Editing or Special Retouches. Packages include basic editing of the images from the session. Basic editing includes color, tone and contrast adjustment or cropping (if needed). Special retouches include, but are not limited to, skin smoothing, digital make-up, erasing details, objects or people, among others. Special retouches will be billed accordingly. 

• Online Galleries. Most Packages include Online Galleries where the Client will be able to view the images from the session and order additional products. Online galleries will be available to the Client for 30 days from the date of the session. After 30 days, there will be a $25 reactivation fee. After 180 days there will be a $50 reactivation fee. After 365 days, there will be a $100 reactivation fee plus any un-archiving fees. 

• Image and order storage. Images from the session will be stored and can be retrieved for up to one year after the session, After one year, images and/or orders may be subject to disposal and may not be retrievable. 

• Other. This Contract/Agreement incorporates the understanding of all terms and conditions. With the Client's signature all terms and conditions are accepted. Any changes to these terms will be subject to approval and a new contract. The Client understands that PBS, its affiliates, associates, family members or relatives will not be held responsible in any case of accident, illness, condition, damages or losses that occur as consequence or not of the activities associated with the session described in this contract, on the studio or location (s) where ir occurs.
